01
Scope
Ojerk respects intellectual-property rights and will review notices concerning material, previews, links or references accessible through pages operated by Ojerk. Some underlying content is hosted or controlled by independent third-party platforms. When content is outside Ojerk's direct control, Ojerk may remove or disable its own link or reference and may refer the complainant to the responsible provider.
If you are a performer asking for removal of your profile for privacy, consent or identity reasons rather than copyright infringement, use the contact page instead.
02
What a copyright takedown notice should include
To allow Ojerk to evaluate a notice under the U.S. Digital Millennium Copyright Act, provide substantially the information required by 17 U.S.C. §512(c)(3):
- Signature. A physical or electronic signature of the copyright owner or a person authorized to act for the owner.
- Copyrighted work. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by one notice.
- Material to remove. Identification of the material or link claimed to be infringing, together with information reasonably sufficient to locate it. Include the exact Ojerk URL whenever possible.
- Contact information. Your name, mailing address, telephone number and email address.
- Good-faith statement. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent or the law.
- Accuracy / authority statement. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
03
Where to send a notice
Incomplete notices can delay review. If a notice identifies the copyrighted work, the material at issue and a way to contact the sender but omits other required information, Ojerk may request the missing information before completing its review.
04
Review and action
After receiving a sufficiently complete notice, Ojerk may remove or disable access to the relevant page, preview, link or reference while the claim is reviewed. Where appropriate, Ojerk may notify the affected source, uploader, partner or provider and may retain records needed to administer the request.
A takedown notice does not guarantee that third-party material will disappear from the internet. Ojerk can act on pages and links it controls; the underlying provider may need to be contacted separately if it hosts the material.
05
Counter-notice
If material controlled by Ojerk was removed or disabled because of a DMCA notice and the affected party believes the removal resulted from mistake or misidentification, a counter-notice may be submitted. A counter-notice should include the information required by 17 U.S.C. §512(g)(3), including:
- A physical or electronic signature.
- Identification of the material removed or disabled and the location where it appeared before removal.
- A statement under penalty of perjury that there is a good-faith belief the material was removed or disabled because of mistake or misidentification.
- The submitter's name, address and telephone number.
- Consent to the jurisdiction of the appropriate U.S. Federal District Court and acceptance of service of process from the original complainant or that person's agent, as required by law.
Where the statutory procedure applies, material may be restored after the legally prescribed waiting period unless the original complainant provides notice that a court action seeking to restrain the allegedly infringing activity has been filed.
06
Repeat infringement and misrepresentation
Where appropriate and applicable to the service, Ojerk may restrict or discontinue relationships, feeds, sources or access associated with repeated copyright infringement. Ojerk also reserves the right to reject abusive, fraudulent or materially incomplete notices.
Knowingly making material misrepresentations in a DMCA notice or counter-notice can create legal liability under U.S. law.
07
Other legal or performer requests
For privacy requests, performer/profile removal, consent concerns or other legal enquiries that are not copyright claims, use the contact page and include the exact page URL plus enough information for the request to be reviewed.
